Auction terms for San Antonio del Mar Ocean View Hacienda,
Located at Calle Isla 515, San Antonio del Mar, B.C. Mexico
Property has been reduced from $585,000 asking to list price of $489,000
Property has an existing reserve price minimum bid of $435,000 USD
Seller retains the right to terminate auction and sell directly to first offer above $489,000
All bids to be accompanied by $5,000 check payable to First American Title and a signed Letter of Intent to
purchase (appended herein), delivered in either hard copy or electronic version to the listing broker’s
office. Seller will inform the winning bidder and sign acceptance of the winning bid amount within 24 hours
of close of auction. All non-winning bidders will be notified by email and refunded their deposit in full within
2 working days of end of auction.
Should two or more bids of the same amount be received by the listing broker, the first such bid received
will be the one honored by the seller.
Winning bidder will place 10% of sale value into First American Title Escrow account within 3 days of close of
auction and close with all cash purchase within 60 days of end of auction. No “subject to financing” clause
will be accepted.
10% deposit will be non-refundable and considered as liquidated damages if buyer fails to close transaction
within 60 days plus any reasonable grace period as may be required if circumstances beyond the control of
either buyer or seller should occur, such as delays within the fiduciary bank transferring the beneficial
rights of the existing trust. Buyer is to comply with all requests for needed documentation by the bank within
5 working days of close of auction. Escrow disbursement instructions to this effect will be signed by both
buyer and seller within 7 working days of close of auction.
Seller to provide buyer with copy of all existing title verification and buyer to obtain copies of certificates of
no liens to verify transferability of clear title within 7 working days of close of auction, at which time the 10%
deposit will become non-refundable. Seller declares under oath the property is sold as free and clear of any
back taxes or liens.
Buyer and seller agree to choose an efficient closing service or attorney, from a list as provided by the Latin
American Division of First American Title in Miami, Florida, USA.
Buyer to absorb all closing costs including acquisition tax, surveys, appraisals, certificates of no liens,
Notario Publico fees, bank trust fees, public registry fees and buyers’ closing attorney costs.
Seller to pay all sales commissions and any capital gains taxes, if applicable, to be deducted from sellers’
proceeds at the time of closing in Notario Publico’s office.
Property sold “as is” with all systems in good working order, with no "subject to financing or inspections
after close of auction. Any inspections may be done by bidders prior to close of auction at buyer’s expense.
Property is sold furnished, and seller is to provide a written list of any artwork, furnishings and personal
items to be removed prior to sale.
